Pensioner to seek damages from council for fall
A pensioner is seeking personal injury compensation from Barnsley Council due to injuries he sustained during a fall in early 2008.
Clary Day, an 81-year-old resident of a small village within the Barnsley area called Monk Bretton, suffered a severe shoulder injury when he slipped on some grass cuttings that had been discarded on a footpath at the top of a steep path, The Star newspaper reports.
Mr Day was unable to use the handrail as it was blocked off by the foliage and consequently slipped over. He was unable to move his left arm properly for several months after the incident and still feels pain in the affected area some two years on.
The man told the news publication that he was on his daily morning walk when the event occurred and added that it left his shoulder "pounding with pain".
He insisted that he will see his case through because the cuttings represented "an accident waiting to happen".
