Midwife seeks compensation over alleged injury in couple's home
A midwife who alleges she suffered an injury while visiting a couple and their baby at home has begun a legal battle for compensation, it has been revealed.
Caroline Waller visited the property of Michelle and James Hudson last month three days after they had their second child, the Telegraph reports.
She claims that, while at the house, she stumbled over a child's buggy, which had been folded and was situated at the bottom of the stairs.
Ms Waller is now taking legal action under the Occupiers Liability Act 1957.
Under the Act, occupiers and others can be prosecuted for injury or damage resulting to persons or goods lawfully on any land or other property which arises as a result of dangers due to the state of the property.
Ms Waller is employed by the Hull and East Yorkshire Hospitals NHS Trust, although the organisation is not involved in the legal case.
