A toy distributor along with a builder the firm employed have been sentenced after a worker was killed when he fell through a warehouse roof in July 2012.
The 39 year-old man had been helping his colleague clear debris from the roof when he stood on a fragile plastic panel and plunged nine metres to the concrete ground below.
After a Health and Safety Executive (HSE) work accident investigation revealed that no safety measures had been put in place to ensure the job was carried out safely, both the toy firm and the victim’s colleague were prosecuted.
Preston Crown Court heard that the firm had employed a builder to clear debris from their warehouse roof but had failed to conduct any employment checks to verify the man was competent.
When he and the victim climbed onto the 36,000 square foot roof, they did so without any kind of prior preparation or work plan in place and they had no equipment such as harnesses to ensure their safety.
After the Lancashire-based toy distributor pleaded guilty to a single breach of the Health and Safety at Work etc Act 1974 by failing to ensure the worker’s safety, the company was fined £200,000 and ordered to pay nearly £10,500 towards the cost of the prosecution.
The builder the firm employed was found guilty of a breach of the Work At Height Regulations 2005 and was given a 6 month prison sentence, suspended for 12 months.
The aim of the Work At Height Regulations 2005 is to prevent death and injury caused by falls from height. Employers have a duty of responsibility to ensure any work at height is properly planned, supervised and carried out by competent people.
