Potholes are created by the cold and wet winter weather and a shortage of maintenance in keeping roads (and pavements) in a serviceable condition. With an increase in compensation claims by UK motorists in the previous financial year, there is a heightened risk of cycling accidents caused by potholes.
Cyclists face many dangers on the roads beyond their control with motorists and potholes.
In November 2014, Olympic cyclist Dani King suffered five broken ribs and a collapsed lung due to a pothole accident whilst training in Wales. The local authorities in the Gwent area of South Wales paid out over £14,000 in compensation caused by potholes in the last financial year.
In 2011, the Gwent council’s ‘Project 21’ was said to have plans for an investment of £21 million in eradicating pothole accidents on footpaths and roads.
The RAC Foundation reported a total of 234 pothole damage claims were made against Gwent councils from 2013-14, 92% of which were successful. In total, over 48,000 drivers made pothole damage compensation claims against councils across the UK. This figure has increased by more than 2,000 since, equating to a new claim submitted every 11 minutes for 365 days of the year. In total, £3.2million was paid out for successful compensation claims with an average of £286 for a successful claim.
The damages sustained by motor vehicles by potholes is likely to have more severe consequences on a less-protected cyclist. The rules of the Law are in place to protect cyclists in the event of an accident that isn’t their fault.
If you suffer an injury caused by a cycling accident it is important that you receive expert legal advice and rehabilitation as soon as possible.
For the best chances of successful compensation for your accident we advise that you provide as much evidence as possible to support your claim. This could include the names, phone numbers and addresses of at least two witnesses; photographs of the pothole and your resulting injuries from the site of the accident; and a visit to a doctor if you have been injured.
Claims Direct can support you through this process, ensuring you get the treatment you need quickly; while our Bicycle Accident Lawyers work to get you all the compensation you are entitled to.
