A worker died in a chemical tank at work due to negligence on the part of his employer.
Steven Conway was working in a chemical tank at Diamond Wheels (Dundee) Ltd when he was overcome by fumes and died.
Mr Conway had been sent to clean the tank that contained a chemical known as EFX Strip. It contains highly toxic chemicals such as methylene chloride, methanol and hydrofluoric acid. The compound is known to be highly volatile.
Diamond Wheels has been investigated by the Health and Safety Executive and it has been found that Steven was sent to clean the tank without any overalls or protective clothing, and the mask that was supplied was not suitable for keeping out toxic fumes.
The HSE found that Mr Conway was sent to clean the industrial tank in just tracksuit bottoms, a t-shirt, a fleece jacket and trainers. He suffered chemical burns to his thighs, knees, shins and feet. The official cause of death was inhalation of industrial paint stripper.
Diamond Wheels, operated by former Dundee FC director of Football Paul Marr, has been fined £50,000 for breaching health and safety laws.
In the UK employers have a duty of care to look after their staff, including providing the appropriate work wear for the requested job. All equipment and machinery must adhere to strict standards and you have the right to say no if you don’t think what you are doing is safe.
Every business has to have employer’s liability insurance if they have people working for them so if you’re injured at work through no fault of your own you can claim compensation. This comes from the insurance company and not your employer so you don’t have to worry about them being out of pocket. You also can’t be fired or made to feel bad about claiming compensation for a work accident.
The Personal Injury Lawyers at Claims Direct help you if you have been injured at work on a No Win No Fee basis.
