Daniel Brown was hurt while working at premises owned by Countrystyle Recycling - a firm established in 1996 - in Folkestone in February 2010 when a tyre of a shovelling machine weighing 16 tonnes ran over his right foot.
The 19-year-old sustained 16 fractures in his foot and has now developed arthritis in the affected area of his body. As a result of the incident, he has had to give up a potential career in motocross - a sport he had previously competed in at national level.
He has also not been able to return to work since the accident and is unable to learn to drive.
An investigation by the Health and Safety Executive found that Countrystyle had not established a proper system to prevent pedestrians from coming into contact with vehicles, meaning Mr Brown could now seek damages.
