According to the Worcester Standard, Ronald Fryer suffered a fractured metatarsal when he slipped over in a Tesco supermarket in Worcester in October 2009.
The 80-year-old fell over on a wet floor and told the news source the injury caused him "unbearable" levels of pain, which resulted in him deciding to take legal action against the retail giant.
He was taken to Worcestershire Royal Hospital - an institution managed by the Worcestershire Acute Hospitals NHS Trust, which employs more than 5,500 people - and diagnosed with the break.
Mr Fryer went on to tell the news source he is concerned that more individuals will sustain similar injuries unless action is taken to rectify the problem of wet floors.
His legal representative indicated that Tesco had "neglected its duty of care" to the elderly man.
